HCJ to state: Demolish nine structures in the settlement of Ofra

Israel’s High Court orders state to carry out demolition orders issued for nine structures in the settlement of Ofra, despite state objection. Court: Denying the petition would have sanctioned severe harm to Palestinian rights and rule of law, which is unacceptable

In a dramatic decision, Israel’s High Court of Justice (former President A. Grunis, President M. Naor, and Justice I. Amit) ruled Sunday that the state must carry out demolition orders issued for nine illegal structures built on privately-owned Palestinian land in the West Bank settlement of Ofra. The Court accepted the petition filed by Palestinian residents of nearby villages and Israeli human rights organizations Yesh Din and B’Tselem to enforce the law regarding illegal construction in the area. In light of the state’s claim that the nine structures essentially share the status of many other houses in Ofra, the ruling has far-reaching implications for the issue of illegal construction on privately-owned Palestinian land.

The petition was filed in 2008 by five Palestinians from the village of ‘Ein Yabrud and Israeli rights organizations Yesh Din and B’Tselem against the minister of defense, OC Central Command, and the head of the civil administration, while construction of the structures and their connection to infrastructure was under way. The petitioners demanded that the court instruct the authorities to carry out demolition orders previously issued for the structures, prevent their connection to power, water and sewage networks and prevent people from taking up residence in the structures pending a ruling on the matter. In June 2008, the HCJ issued an interim order forbidding further construction or use of nine houses. In March 2009, after being notified that the order had been violated and people had taken up residence in the houses, the Court also issued an order nisi instructing representatives of the state to explain why the stop-work and demolition orders had not been implemented.

Unlike in other cases concerning illegal Israeli construction on Palestinian land in the West Bank, the state claimed in this petition that due to “special circumstances”, the usual priorities for enforcement of planning and building laws did not apply in this case. The “special circumstances”, the state explained, were that most structures in Ofra had been unlawfully erected on privately-owned Palestinian land, i.e. their status was almost identical to that of the nine structures under examination. The state’s problematic argument was that as almost the entire settlement of Ofra had been built on privately-owned Palestinian land, there was no justification to demolish those particular nine structures – although they were new and the petition was filed before they were completed. Therefore, the state argued, the fate of the nine structures would be determined along with the rest of the settlement, through negotiations on a permanent-status agreement with the Palestinians. State representatives referred to Ofra throughout the court sessions as “the largest illegal outpost in the West Bank”.

Last night, the Court rejected the state’s position and ordered execution of the demolition orders issued for the nine structures. In the ruling, the Court harshly criticized the conduct of various parties who worked to expedite construction of the structures after the petition was filed, in order to have them inhabited before the Court ruled on the matter: “The petition that lies before us pertains to structures that were unquestionably built illegally. They were constructed on registered land that is privately-owned by Palestinians […]. In addition, the construction was carried out in breach of stop-work orders and demolition orders issued by the authorities, and was completed in what appears to be foul play after the petition was filed.”

The Court added that accepting the state’s position “would have sanctioned severe harm to Palestinian rights and rule of law, which is unacceptable”.

Att. Shlomy Zachary of Yesh Din’s legal team said in response: “The High Court of Justice made it unequivocally clear that the property rights of protected persons and basic values such as the rule of law cannot be part of political wheeling and dealing or contingent on diplomatic negotiations. These are basic rights and their fulfillment must be safeguarded. One can only hope the state does some serious soul searching regarding the outrageous positions that justified violating the interim order under the presumption that different rules apply to Ofra and its residents.”

Hagai El-Ad, executive director of B’Tselem, stated: “In the years that have passed since the petition was filed, Israel’s land grab in the West Bank has continued vigorously. Whether carried out through declaration of state land – which state? – or taking control of privately-owned Palestinian land, the trend remains the same, and it has been led by Israeli governments for decades. The Court’s decision does not change the larger picture.”

New B’Tselem report: Israel is carrying out an elimination project in the West Bank

B’Tselem’s most comprehensive report to date on Israeli policy in the West Bank finds that Israel is using five mutually reinforcing mechanisms to dismantle Palestinian collective existence there and forcibly reorganize the territory to establish a permanent, contiguous Jewish-Israeli presence and sovereignty.Since late 2022, and especially since October 2023, Israeli policy in the West Bank has entered a new phase. Israel has sharply escalated longstanding policies of control, violence and dispossession, implementing them more openly, more violently and at a faster pace. These measures are also becoming increasingly institutionalized in government policy and practice. With this process intensifying by the day, B’Tselem is publishing The Elimination Project, a 200-page report based on an analysis of approximately 2,000 testimonies from Palestinians in the West Bank, additional field research and decades of documentation. The report traces the acceleration and expansion in recent years of longstanding Israeli policies and practices.“What Palestinians are living through in the West Bank is not a series of separate incidents. It is a single political project that reaches into every part of life,” said B’Tselem Executive Director Yuli Novak. “Communities are being expelled, the economy is being pushed toward collapse, and millions are living in constant fear of Israeli military or settler violence. These mechanisms work together to dismantle Palestinian collective life while entrenching a permanent system of Jewish supremacy across the West Bank. The world is watching and still failing to respond with anything close to the urgency this demands.”How the Elimination Project worksThe report identifies five interconnected mechanisms through which Israel is advancing this project across the West Bank:Violence and intimidation: Israel is using military forces and armed settler militias to impose violence, fear and coercion. From 7 October 2023 through 31 August 2026, Israel killed 1,107 Palestinians in the West Bank, including 245 children.Ethnic cleansing and territorial takeover: Israel is using military operations, demolitions and state-backed settler farms and outposts to drive Palestinians from their land and expand Jewish presence there. To date, 75 Palestinian communities have been forcibly displaced; settler farms and outposts have taken control of 1.07 million dunams of land (18% of the West Bank); and about 33,000 Palestinians have been displaced from refugee camps in the northern West Bank.Movement restrictions: Israel is fragmenting Palestinian space through checkpoints, gates and roadblocks. By the end of 2025, OCHA documented 925 movement obstacles throughout the West Bank.Economic strangulation: Israel is using its control over employment, Palestinian revenues, finance and infrastructure to deepen economic crisis and dependence. Unemployment rose from 13.1% in 2022 to over 31% in 2024, amid mass permit revocations and intensified withholding of revenues.Social and political destruction: Israel criminalizes political organizing, raids and shuts down civil society offices, suppresses protests and arrests activists, students and journalists. Since October 2023, Israel has arrested at least 60 Palestinian journalists from the West Bank. The political blueprint: The report identifies Bezalel Smotrich’s 2017 Decisive Plan as a key document for understanding the current escalation. Its strategy of “victory through settlement” seeks to make Jewish sovereignty irreversible through settlement expansion, land takeover and Palestinian displacement, while leaving Palestinians three options: submit to Jewish supremacy, leave, or face military repression. Though the plan was never formally adopted as government policy, Smotrich now holds broad powers over planning, land and enforcement in the West Bank, and core elements of its logic are increasingly reflected in state policy and practice.Decades in the making: The Elimination Project long predates the 2017 plan and the current Israeli government. B’Tselem situates the current Israeli assault on Palestinian life within a long-term settler-colonial project operating through Israel’s apartheid regime. In the Gaza Strip, this logic has reached its most extreme form in the genocide Israel is committing; in the West Bank, the current government has accelerated the project and made its mechanisms more overt.International responsibility: B’Tselem calls on governments and international institutions to stop treating Israel’s violations as isolated incidents, stop enabling Israel’s crimes, protect Palestinians and act to end Israel’s apartheid regime and military rule. A just future requires a political order based on freedom, justice, equality and democracy for all who live on the land between the Jordan River and the Mediterranean Sea, with full realization of individual and collective rights and equal political participation.B’Tselem Executive Director Yuli Novak said: “Palestinians are being left exposed to escalating violence while Israel advances its project of elimination in the West Bank. Governments cannot condemn these crimes while granting Israel the impunity to continue. Together with international institutions, they must use every means available under international law to stop Israel’s crimes and halt the machinery of violence and destruction that is tearing Palestinian life apart.”The full report, executive summary, maps, and graphs are available at the following link: https://www.btselem.org/elimination/?lang=en

The Elimination Project: Israel’s Systematic Dismantling of Palestinian Life in the West Bank

Open-Fire Policy

The Elimination Project

Since the current Israeli government took office at the end of 2022, and even more so since October 2023, Israel has dramatically escalated its assault on all aspects of Palestinian life in the West Bank. At any moment, Palestinians may be exposed to violence by soldiers or armed settler militias, arrested and imprisoned, subjected to abuse and humiliation, and sometimes even killed. The Elimination Project draws on more than 2,000 testimonies B’Tselem collected from Palestinians since October 2023 and over three decades of documenting the Israeli apartheid regime’s human rights abuses in the West Bank. The report looks at the current reality not as a collection of isolated incidents or specific harms, but as part of a comprehensive mechanism of elimination that works to dismantle the conditions for continued Palestinian existence in the West Bank, while deepening Jewish control and supremacy in an irreversible manner. An examination of the current reality in the West Bank reveals that the project of elimination is now being implemented more openly, directly and violently than before, and increasingly relies on cooperation between official state authorities and settler militias operating in the West Bank with state backing and support.

East Jerusalem

The ethnic cleansing in East Jerusalem is happening now - Large Israeli forces are currently entering the Silwan neighborhood to evict 11 Palestinian families from their homes.

Amidst the ongoing illegal and lethal Israeli-American offensive against Iran, Israel is expanding its ethnic cleansing in East Jerusalem, throwing Palestinian families into the streets.Initial reports from the ground: Police forces have sealed off the entire neighborhood and are preventing anyone includes journalists from entering. Preliminary reports indicate violence and the arrest of family members. At this very moment, settlers brought to evacuate the houses are actively throwing the families' belongings out of the windows. The eviction of 11 families, which is taking place at this very moment, marks the beginning of a massive displacement wave: approximately 2,200 people in Silwan are facing an imminent threat of forced displacement - 150 families (1,500 individuals) in al-Bustan and 90 families (700 individuals) in Baten al-Hawa.The forcible displacement follows the Israeli Supreme Court's decision to dismiss the appeals of 20 Palestinian families from Baten al-Hawa, leaving 136 individuals at immediate risk of losing their homes. This is the reality of systematic, institutionalized violence and a clear manifestation of an Israeli policy aimed at engineering the demographic balance and "Judaizing" the neighborhood by exploiting discriminatory laws. These measures are designed to expand Israeli presence and control over one of the most politically and religiously sensitive areas in the region, serving as a crucial component of the broader ethnic cleansing currently unfolding across the West Bank.
